The Famous Five--




今天是Women's March 遊行日…來個卡加利知名的旅遊景點:在Olympic Plaza 的The Famous 5 雕像吧。





這是加拿大女性從政的一個開端
其中一位Emily Murphy想要擔任加拿大的參議員,但是一連三任的總理都拒絕讓她擔任,因為總理認為:「女性不是人」。
最後,他們在1927年時提出了釋憲案,
"Does the word 'Persons' in Section 24 of the British North America Act, 1867, include female persons?"
(簡單翻議:"人" 英國北美屬地法的的定義,是否包括"女性")?
並且被法院一致判定,女性不是人
(後來在1929年的時候,此法案被英國的法院再推翻…當時,加拿大還是英國屬地之一)
而這個法案被稱為Persons Case,一個很有名的釋憲案

看wiki,發現其實他們五個最後都沒有當上參議員,但是Emily Murphy成為了大英帝國第一位女性法官










Today, we have a protest in Calgary, called "Women's March". So let's see The Famous Five sculptures.

This is the beginning of women influence in politics.

Emily Murphy, one of the famous five, wanted to become Canada's first female Senator, but three consecutive prime ministers refused to appoint her because "she was not a person"

Finally, they asked the Supreme Court of Canada: "Does the word 'Persons' in Section 24 of the British North America Act, 1867, include female persons?"

Canada's Supreme Court summarized its unanimous decision that women are not such "persons".
This judgement was overturned by the British Judicial Committee of the Privy Council in 1929.
This case is well-knowned as "Persons Case"

None of the five didn't become the Senator eventually, but Emily Murphy became the British Empire's first female judge.
